Terms

Ordering and Contract Formation:

To use our services, you (the “Customer”) must be of legal age and agree to these Terms & Conditions. Customer acknowledges and agrees that placing an order and receiving order confirmation from Springfield Dumpsters (the “Contractor”) forms a binding and enforceable agreement between Customer and Contractor. 

Contractor intakes and processes all dumpster rental orders via telephone or through the website www.springfielddumpsters.net By completing and submitting dumpster rental request and providing credit/debit card payment information, the Customer agrees to the pricing of the requested service(s), affirms that the payment information provided is validly issued to Customer, and gives permission to the Contractor to process all charges on the Card for the requested service(s).


Pricing & Payments:

Customer agrees to pay dumpster rental fees according to current fee schedule published on www.springfielddumpsters.net including any overages incurred due to extra weight, overloading or additional days. Customer is responsible for any additional fees assessed by the landfill for certain items such as tires, appliances, etc.

Payment will be due prior to dumpster delivery to Customer. Any additional overage charges or other fees not paid prior to delivery are due within 7 days of the dumpster pickup date. Dumpster rentals may be rescheduled, however, there is no refund upon cancellation. Any unpaid balance after 14 days of dumpster pickup date will start to accrue 15% interest from the date of pickup until paid in full. Minimum late payment fee is $25.00.


Dumpster Use:

The following substances may not be placed into rented dumpsters:

Customer is responsible for dumpster contents and is considered it’s owner until accepted by the disposal facility. Any extra charges caused by the disposal of unsuitable or restricted materials will be the responsibility of the Customer. 

Dumpster may not be filled above the top rail, dumpster doors must be closed and secured before it can be moved. Additional fee of $85 plus all applicable disposal fees will be charged to Customer if a dumpster is overfilled. 

Customer may not move or attempt to move the dumpster from its original place of delivery. The fee for Contractor to relocate a dumpster is $85.

The allowed tonnage is 2 tons for any dumpster. Customer agrees to pay an additional fee of $150.00 per ton for each ton in excess of the weight limit of the rented dumpster. If the dumpster is loaded over its weight capacity and Contractor is cited for being overweight while transporting a dumpster from the Customer, the Customer will be responsible for reimbursement to the Contractor of the fine amount. If a dumpster cannot be removed because of excessive weight or overfilling, it will be brought into compliance at Customer’s expense.

Lighting fires in dumpsters is strictly prohibited. Customer will be liable for any loss or damage to rented equipment in excess of reasonable wear and tear.


Access & Ground Conditions:

Customer is responsible to ensure unobstructed access to and from the delivery site as well as suitable ground conditions for delivery, placement and removal of the dumpster. If the dumpster is blocked and cannot be removed, an additional trip charge of $85.00 may be applied. 

Customer agrees to indemnify and hold harmless Contractor of any damage which may occur to the property where the equipment is located. All reasonable care will be taken during placement and removal of the equipment to protect the property. Contractor will not be responsible for payment markings, road surfaces, sod, lawn, asphalt, landscaping, overhead obstructions, etc.


Contractor’s Duty to Customer:

Upon acceptance of the request for service from the Customer, the Contractor enters into an Agreement with the Customer to provide the services requested by the Customer in a timely and professional manner.


Customer’s Duty to Contractor:

Customer agrees to hold harmless and indemnify Contractor, the Contractor’s owners, subsidiaries, affiliates, officers, employees, agents, and corporate affiliates against all claims, lawsuits, and other liability for injury to persons or damage to property arising out of the Customer’s possession of or use of the dumpster. Customer agrees to obtain any permits in accordance with local ordinances and laws pertaining to the placement of an ordered dumpster.


Legal:

Governing Law. This Agreement shall be construed and enforced in accordance with the laws of the State of Illinois.

Severability. Customer agrees that each provision in these Terms & Conditions will be treated as a separate and independent clause, and the unenforceability of any one clause will in no way impair the enforceability of any other clause. 

Waiver. A waiver of any claim, demand or right based on the breach of any provision of this Agreement will not be considered a waiver of any other claim, demand or right based on a subsequent breach of the same or any other provision.

Reservation of Rights. Contractor expressly reserves all rights and remedies which are available to it at law or in equity.  

Entire Agreement. These Service Terms & Conditions constitute the entire agreement between Customer and Contractor and supersede all prior agreements and understanding, oral or written, between Customer and Contractor. Any change in these Service Terms & Conditions must be approved by Contractor in writing.
